I can’t give any insight to leave to remove but I have been through Specific Issue for relocation within jurisdiction. And much of the critera outlined above is the same.

My application was to move to a different county (50 miles) within the U.K. The entire process has taken 12 months, a total of about 5 hearings, a Cafcass S8 report (which endorsed the move), followed by a trial. It was contested through out, it was so unbelievably stressful. At times I almost wished that I hadn’t started proceedings. But I had no choice, he wanted full residence, which subsequently changed to shared care, both of which were refused by the court. Thankfully the outcome was positive for us. The district Judge managed to get a firm handle on the situation and made the right decision.

In my opinion, it was a monumental waste of everyone’s time and it was simply an effort on ex’s part to deplete marital funds. He succeeded, 200k wasted to date. The funny thing was that had agreed to the move, then changed his mind at the last minute. Nobody benefited apart from the legal team and the court. The courts should take a view on such matters, resolving them quickly because the upheaval, living in uncertainty has been just awful. But at the same time they need to be though and wade through the allegations and lies told to sway the proceedings in favour of one party. As a consequence I think our co-parenting relationship has been damaged beyond repair.

My honest advice is, if moving is absolutely necessary for your future happiness and financial stability like it was for me, then go ahead make that application. If not. Just don’t do it.

I was successful in my application to move myself and children from the UK to another country but it is a very traumatic experience for all involved.
