I am now divorced and wanting to take 13 year old daughter abroad this summer.
I have read on here about one parent having to obtain permission from the other to take children out of the country-is this standard in all circumstances or just some?

Permission from either the other parent with PR, or the COurt is required unless there is an "old" Residence Order or a "new"Child Arrangements Order that states your daughter resides with you, then you will require consent from all those with PR (usually it''s just the other parent that also has PR) for you to take your child out of the UK. If consent isn''t forthcoming, then you will need leave from the Court (Specific Issues Order) to take your child abroad.

This applies across the board, unless only one parent has PR.

Thanks Ruby for your prompt reply but am I missing something but my daughter lives with me with no formal arrangement with her father. She texts him when she wants to see him and they arrange it, we aren''t on speaking terms. There was no order regarding her in court? Should something have been ordered in court?

If there are no disagreements as such over your current informal arrangements, then there''s no need for a CAO.

I suggest you email or write to him, to let him know when you are intending on taking you daughter on holiday and requesting his written consent to taking her out of the UK. IS there likely to be an issue?

I really don''t know till I do it Ruby! I guess its a case of letting him know and asking his permission in plenty of time. I''ll let you know-thanks for your advice.
