Alcoholic ex

Hi.

My now ex partner, mother to our ten year old son, is now living with another man she met through rehab. She is alcoholic, having suffered a seizure last year and spent weeks in hospital. Since discharge there have been many blips. The guy she’s with is also alcoholic and is/was on pain killers. There is a 12 month habitation order now in place, the impact on us has been huge.

Once the lockdown clears the way, I will relocate. My legal council has advised that this is good to go and I have social services support for this. The house is in joint names, although I have funded almost all of the capital in it. Having originally purchased it, I added her to the mortgage before we became parents. Value is approx £425K with £20K balance. The house will need to be sold but I’m unsure how this can be leveraged if she doesn’t agree to sell?



Considering the alcoholic history and the property funding, please can anyone offer me advice?

If she won't agree then you would have to seek the assistance of the court.

They could order it to be sold and give you sole control of the sale.

Thanks for the reply. We are not married, so no divorce involved. To add to the complexity, she has raised unfounded allegations against me, just waiting to speak to the Police about this and move forwards.
