Hi my wife left the family home to shack up with her lover. they have rented a place 5 miles away. He has two kids and we have one 5 year old. We all work and are financially solvent. We are sharing custody of our child 50/50.

My wife has stopped paying into our joint account, but wants to pay half the mortgage until we get to the legal bit of the divorce.

She says this is because when we come to value the property we will have continued to be equal in contributions and it won''t be messy with the calculations.

I find it hard to trust my wife after being betrayed by her, so I was wondering if there could be some ulterior motive for continuing to pay half the mortgage. Would her solicitor advise such a thing? would it affect the settlement more in her favour?

Thanks

If both names are on the mortgage them you are both liable for the payments. She could leave you with the whole amount to pay which would be seen as you paying to live in her share of the house. So in your shoes I would take her up on her offer. It won''t make any difference to the financial settlement.
