What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

As part of my divorce many years ago, a Mesher Agreement was signed between myself and my ex. The trigger points in this Agreement have been reached and I've written to my ex twice asking her to release my share in the former marital home. She has failed to respond and the house is still not up for sale. I did include a line in my letter advising if she did not respond and I had to start enforcement proceedings, I would pass on the costs to her. Does anybody know the process to begin enforcement please? Legal costs when I got divorced topped £35K as my ex is a very difficult person so I am looking to do as much myself to keep costs down. Any tips or information would be gratefully received.

A D11 form, send with a short statement of what you are requesting, a copy of the original order and copies of the two letters you have sent to your ex.

You need to send three copies of everything and a cheque. I’ve only ever paid £50.00 but I believe some others have paid £155.00.
