What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I had a final hearing scheduled but with two weeks to go we reached agreement, in open correspondence.

Consequently, the Final Hearing was not pursued but ironically just before the actual Final Hearing date when my solicitor sent the draft Order, the other side reneged on our agreement as they challenged one particular item that had been clearly documented and with integral to my agreement overall.

So, currently my view is that we have no agreement as far as I'm concerned nor if they still wanted to proceed I'm not sure I do given the way they have treated me.

The other side is the applicant and I'm the respondent.

I consider our accord irrevocably breached on principle but no Final Hearing date.

We have a Court Mention time of 10 minutes on 28th November.
