What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I am planning to go to the first hearing with a detailed financial settlement offer, is this allowed ?, the idea of another 6 months of this just pisses me off.

Do you have full sight of all the financial information of your spouse?

The first hearing requires parties to have exchanged form E, Statement of Issues, Chronology and questionnaire. The hearing itself is a short one, usually no more than 30 minutes and the Judge will encourage the parties to meditate and find a resolution out of court; and state what further information will be required for the FDR. It would be at the FDR stage that offers from both sides would be expected.

Yes i have both Form E's, just curious if an offer is made and accepted, whether you still have to continue court proceedings

Regarding Form E, we received my wifes Form E, raised questions and sent them back to her, she has not sent any questions to me regarding my Form E, is now 2 weeks to court, are they not obliged to question me or are they only obliged to send any queries regarding my Form E to the court before the hearing ?
