What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I recently applied for divorce, it was uncontested by my ex. I submitted all the paperwork and paid all the fees.
The clerk called me yesterday to advise me that the judge denied my application as my ex owes me 1800$ in child support arrears and she feels that "Proper arrangements have not been made in regards to the children".

I cannot get a divorce because he owes me money??? It makes no sense and I am beyond frustrated.
We have been separated for 4 years.
I don't even care about the money anymore, its like getting blood from a stone.

Can anyone help me?? They told me to get a lawyer to get the money, but that seems redundant as a lawyer would inevitably cost double then what I would still never get out of him for the arrears....

Any help would be so appreciated.

Hi,

As this is a UK site - and child maintenance is dealt with differently here - I am afraid it is unlikely anyone will be able to help with your specific legal query. We are however happy to offer support and assistance with anything that doesn't require a knowledge of Canadian law.
