What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

We received orders from our FDR but I am unclear on some of the points on whether I need to file and serve, just serve or do nothing at all!

Here are the points given:

*At least 6 weeks before the Final Hearing each party to obtain details of their own maximum mortgage capacity etc etc - Do I send this to my ex, the court or both? No mention of file, serve or otherwise

*Both parties to send each other at least 6 weeks before the Final Hearing up to date continuing disclosure of all forms of income etc etc - Do I need to send updated disclosure to the court also?

*At least 6 weeks before the Final Hearing, each party shall serve on the other party up to 10 property particulars suitable for themselves and the other party etc etc - shall I also send this to the court?

Any clarification gratefully received
Thank you!

I would send just to the other side. Key documents like mortgage capacity can be included in the hearing bundle. Anything else can be used to inform an up to date schedule of assets, liabilities and income.
