What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi, my wife asked for a divorce earlier this year while we were both living in France. I reluctantly agreed (she was unfaithful to me) to move back to the UK where we have an apartment. That allowed us to have a UK divorce rather than a French one. We have no mortgage or debts.

The problem is that she is insisting on a 50/50 split of assets even though it will cost me a lot more to buy a house in the UK than a similar sized one in rural France. I contributed 75% of our assets when we married about 7 years ago.

She is happy working as a part time yoga teacher in France while I have found it difficult to find full time work in the UK as I am 62. She is 56. She also has a teachers pension that is worth a lot more than private one.

Do I have a reasonable case to ask the court for a greater share, given our different living expenses and her wish not to get a full time job earning better money?

You could offset some of your entitlement to a share of her pension against cash. This would give you more capital.
If she can be housed appropriately for less than 50% of the capital you could make a case for an unequal split.
