What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi
My ex and I were ment to be sorting finances before finalising divorce. I then get a letter stating conditional order had been applied for and now signed off. I asked that he confirms he will wait before applying for final order but he's told me he's already done it and will be completed 22nd Dec. We are due to exchange form E so we can start mediation so this came as a shock. I now need to complete FORM A without attending MIAM as no time.
Which section do I need to tick and fill in to do this?

There's no rush to do the Form A. Financial claims are not ended by final order. It is generally advisable to wait to apply for final order until finances are settled. This is more important where say the FMH is in the name of only one of the parties and there's a home rights notice because these are ended by final order. Pensions too can be an issue. Automatic rights to a dependant's pension end when the marriage is dissolved. There can also be issues around interim maintenance.

If any of these apply you can put in a D11 application to prevent the final order from being granted.
