What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I would suggest the first section should be ES2 and ES2 and latest open proposals. That the key information the judge will need. If there's a statement of issues and chronology put those in too. You can choose to include s25 statements here or on section c.

Section B is all the process documents from Form A to date (all orders, applications and notices). Include the Decree Nisi/ conditional/final order and any child arrangements order if you have one.

C is statements and affidavits so Forms E (no enclosures), answers to questionnaires, schedules of decificiencies, s25 statements

D is documents produced for the court - so anything court ordered in SJE reports. Inc mortgage capacity and properties.

E is evidence on which you wish to rely - so specific documents that support your case.

F can be updating disclosure and miscellaneous documents

Remember not to include anything marked without prejudice including earlier offers. Keep to 350 pages.
