What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi, I am about to send the D81 and the draft Consent Order to the court. Initially, I answered point 16) about a new relationship that 'I have no intention at present to remarry or cohabit'. My spouse's lawyer emailed me to confirm whether this was the case. I am unsure why she is only double-checking this answer out of all the answers. Can you please tell me what the legal consequences are for what I answer to this question? We agreed to split the major assets as follows: She keeps the family home and one of the flats, I keep my company and the other flat, and on today's market value, these assets are equal. In other words, we split 50/50. There will be no spousal maintenance claims as we earn precisely the same. We have three children. One has already moved out of the family home, and two stay at the family home because the flat I am keeping is too small to have them stay overnight comfortably, so instead, I go over every second weekend and pay child maintenance (more than the required minimum by CMS). I have a girlfriend, and sooner or later, we would like to start a life and live together. We do not have dates arranged yet; it will depend on our financial circumstances. Which answer should I tick to protect me best concerning this situation? Many thanks

Just wondering which box you ended up ticking and what the outcome was?
