Hi my husband has means to fund a solicitor and a barrister. I have been just managing things myself without a solicitor so far and have now joined wikivorce. I was wondering if I did instruct a solicitor and eventually a barrister to go to court can I offset these costs in the divorce proceedings or something because it seems unfair that he has the means to pay for a solicitor whereas I don't because he is one who has access to all the funds. I am the one who has filed for divorce via the HMRC portal just paying the £600 odd and submitting the papers which he has agreed to. The next part is Consent Order agreement or something after financials have been agreed. Which I think we're a long way off from.

Usually, each person is responsible for their own costs in financial remedy proceedings.

The starting point for sorting out the finances is disclosure - where you individually list all your assets (in joint and sole names), their values, any debts. It is helpful to know your own mortgage capacity too. form E is the standard disclosure form.

Once you've exchanged the disclosure information, then you are both in a better position to make/consider settlement offers. It's important to get legal advice before you make/accept/reject any offers so that you have a clear understanding of what the law says is fair, what your options are, and what a fair settlement would look like in your particular situation.
