This is a strange one.....or maybe not
Would I be "penalised" regarding finances and have to sell the home if H decides to reside in Assisted Living Care home indefinately.
His choice to be there. At a prior residence, he was deemed with mental capacity and had all professionals helping him with assisting to help him find a flat. But he was served with an eviction notice (abusive to the helpers, non compliance of rules etc) and then causing property damage on the day of eviction. He had personnal pension paid out (and now has a State Pension) which has probably dwindled down considerably and I fear that through his own "couldn't give a **** " attitude to everything, I will be liable for his costs there. Which would be totally unfair considering he has not laid out a penny for anything, not even the phone call for a solicitor!
He has ignored all communication and I am not even trying now. Been married over 40yrs
Anyone else been in this situation?
I have had my first hearing. Judge has ordered he appear at court, or have someone to represent him, with financial disclosure. He was personnally served D Papers directed by the Courts (I think this is the forth lot of Divorce papers he has received by post and by me!) Care Home does not get involved personal matters on the premises.

Where is he now if he has been evicted from the assisted living place?

It will be hard for him to argue he needs more of the pot to pay for a care home if he has been assessed as not needing it.
