What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello - I hope that there is someone out there who can give some advice or pointers. Facts 1. Married August 19882. Separated January 19923. Divorced July 2013 – petitioner was me on the basis of length of separation; no financial settlement.4. DOB of children to both parties :01.10.198225.02.199016.09.19915. divorce petitioned by mother (born 1964)6. No financial claim made at that time for the reasons stated below7. Ex-husband made no financial contribution to the family during the marriage or thereafter despite being asked to in writing in the mid-late 1990s8. Ex-husband returned home to live with parents post separation and continued to live there until last surviving parent deceased9. Mother purchased own home in sole name after separation without any contribution from father10. No financial support for three children from birth up to when they turned 18 years of age11. Mother supported children on her single income. Due to insufficient resources, she was unable to contribute to a personal pension plan as all income covered direct costs of the family12. There has been no contact between the parties since mid/late 1990s13. Father will inherit monies from the sale of parental home. The sale has taken place (subject to probate) and the proceeds are to be split three ways, between the father and his two siblings. my ex-husband is due to inherit a sum c. £400K. It is understood he has commissioned the build of a narrow boat on which to liveSupporting information/Impact : Direct impact on mother includes but is not limited to :1. Financial impact of raising three children without any financial support for myself or the children2. Limitations on my career prospects and the commensurate potential enhanced salary due to sole care and responsibility for our three children3. Inability to make financial contributions to my own future due to inadequate resources to contribute to any plan for my own retirementQuestions : I have the following questions :- To what extent can Io make a claim for recompense due to the fact that I received no financial support throughout or since the marriage and have been directly disadvantaged financially as a result of singlehandedly bringing up our three childreno make a claim for potential earnings lost as a result of my inability (arising from being a single parent household) to advance m y career, given the need to devote time and resources to the family in the absence of any support from the fathero make a claim that, directly due to the foregoing, I am unable to provide for myself in retirement in a way that I would otherwise have been able to

I'm very grateful for any input/feedback.

My worry is on whether you can claim his inheritance. On the other hand he can claim on your house. So it’s tricky situation but one which needs to be sorted once and for all. If you come across a big lottery win…you could potentially have to share it with your ex if you don't get a Clean Break.

Not sure if you can claim child support now. If you had previously and he had built arrears then you could claim the arrears from his inheritance.

Hopefully someone with more experience and knowledge will come along to help. Good luck 🤞

One question I would have is whether he has a pension that you could claim a share of.
The inheritance sounds like it would be enough to meet any housing needs he may have so I would doubt a court would entertain a claim on a property in your sole name purchased after separation, especially if he has failed to contribute. Have he been chased for CM over the years? Have CMS been involved?
