Hi,

I would like to know what my soon to be ex wife can realistically claim after divorce. We don't have any assets and the 2 children we have live with myself which she pays CM though CMS. We live in my partners home which she owns. Could my ex wife claim against the house if I marry my current partner and go onto the mortgage? I'm aware of the Wyatt v Vince case but can't find anything about claims against my current partner and what she owns.

If the house, or part of it, is your asset she could make a claim. How strong her case would be is another matter.

Best thing to do would be to get a Clean Break order to completely severe financial ties with your ex before you remarry.
