What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Do you think it would be allowed for my adult son to be my MF? As he is my Ex's stepson I wonder if it could be seen as mischevious.

I would doubt it.

MFs should not have any involvement or interest in the case; clearly family members would not meet this requirement.

Your son can go to the court with you and wait in the waiting area, if security allow him access.

The criteria for meeting MF requirements are:

that the role and restrictions of a MF are fully understood,
that the Practice Directions have been read and understood,
that the MF understands the duty of confidentiality,
whether or not there is any remuneration (inc travel expenses)
that the MF has no connection or involvement in the case
whether the MF has any relevant experience

Hi Ruby
Thanks for the reply.
It was a CVP hearing and neither Judge or Barrister objected-they just asked him to confirm that he did not have an interest.
I think there would only be a conflict if he lived in the FMH or something like that.
