What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I need to get an idea of what is a reasonable length of time for spousal maintenance before a Clean Break. My ex has a limited income and is asking for maintenance for another 6 years unitl our youngest finishes primary school. She is able and capable of working full time. Working in a full time job at minimum wage should cover 99% of her monthly costs.

I am aware of a previous ruling, Wright vs Wright in 2015 which seems to suggest that it is reasonable to request that someone start working full time after the youngest child turns 7, as with everything related to separating and divorce, things are dealt with on a case by case basis, but I am hoping to get some general guidance for the scenario where one person has the capacity to work but chooses not to.
