What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Agreed a mesher order 10 yeats ago for my share of the house equity. Says it is enforceable when youngest child is 18 or when completes tertiary education.
Youngest child is now 20, has done 4 years of college 16-20 but has now signed up to a 4 year university degree course. Ex says wont release funds until university is completed as this is still tertiary education. After some advice pls, is it still tertiary education at this age? Thank you

University is tertiary education.

What is the precise wording of the order?

Hi, thank you for replying, it says the age of 18 or completes tertiary education. At the time we expected university to start at 18 not 4 years of college first. Does it still count if they will be 24 when finished as its a 4 year course. Thought 21 might be adult education but maybe not. Thank you

It will still count as uni is tertiary education.

Also be aware that because it says tertiary education, not first degree, then if they choose to continue to do a masters or doctorate it could end up being a lot longer than four years.
