What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Delays after private FDR and how to resolve/expedite

I am the respondent in my divorce proceedings. The applicant and I had a private FDR and reached a settlement agreement. Two weeks have since passed and the applicant's legal team (barrister and solicitor) have not advanced work on completing the draft order. My legal team is sitting waiting and has been chasing but is being ignored.

The applicant has a history throughout this drawn-out matter of disregarding timetables, missing deadlines, and being unresponsive. I suspect that's happening now too.

I am of the understanding that what was agreed at pFDR is binding and the order just needs drafting and then filing with the court so that a DJ can approve the financial order. Yet the longer this "holding period" goes on the more nervous I get about the resolution of this matter.

What can I do or have my solicitor do to get the applicant to move things forward? Or can my legal team instead go ahead and draft the order and then get them to check it? Can I ask the court to intervene? Anything else that I could do? Thanks for the advice.
