I have just filed for divorce. I'm living on benefits but there is a small amount of cash in hand work that I do and do not declare. I struggle to make ends meet as it is. My husband has told his divorce solicitor that I don't declare the money. Will this come out in court? What should I do? Will this all catch up with me or are the divorce courts only interested in the actual divorce? I don't know what to do.

The divorce and financial settlement are separate.
You do need to do financial disclosure. This includes 12 months bank statements so anything that goes into your bank will show up. If you complete a form E - the big form for financial disclosure - there's a section for any other income. You can choose to put occasional cash payments in there. Work paid in cash is hard to prove. Unless this was the bulk of your income I very much doubt it would be a big issue. The main interest is meeting housing needs etc.

Are you claiming all the benefits you can? Is he paying child maintenance if applicable? Is this a case where spousal maintenance could be appropriate?
