What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Using a solicitor, I agreed to a global maintenance settlement with my ex husband. The paperwork has not been sent to the court yet. The figure is £1000 made up of child maintenance £850 (we used the s calculator to get the figure) plus £150 extra. My ex has now changed jobs, receiving a 60% pay rise. Using CMS calculator Child maintenance should now be £1450. So Global maintenance is way under. I have asked my ex to review payment. He said no and said he will file a notice at court 'to provide cause'. What do I do? It seems unfair. That the children will not receive the minimum as calculated by cms.

It sounds like global maintenance is no longer relevant to your case. You would be better off simply applying to CMS. I'm a bit surprised he would want to be tied to global maintenance that can be varied when he could get a Clean Break.

If there's been a material change of circumstances that would be a reason to reject the order.
