What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi, I am a LiP heading to my final hearing. I have been asked to provide an updated composite schedule of assets in an ES2 - should this be as of the date of serving the ES2, or as of the last date of updating disclosure? I am a little confused as my ES2 was updated for my PTR with updating disclosure - My ES2 would show different figures without any updating disclosure as I will have paid for my (direct access) counsel fees of which I am taking a loan. Any help would be appreciated. Thank you!

Umm. What's the gap between PTR and the date of the hearing?
Has further updating disclosure been ordered?
If it has not and the gap isn't huge, I think it's reasonable to use the same figures but add in the loan you've taken out for legal fees. Your costs should be set out in Form H and included in the bundle.

Thank you for your message - in the end I decided to disclose up to the date of the hearing
