Hi, new here

ex husband is on police bail for assault. House has always been in my name as his credit was terrible.

I need to sell it asap as due to him financially abusing me over all these years, I can no longer afford to live here. I am paying over £1k per month to debt.

can I sell it and keep his 50% of equity in trust? Then when we divorce, i will negotiate with him. Can't negotiate currently due to bail conditions. And as he is emotionally and psychologically abusive, I don't want to see or speak to him.

don't want to waste loads of money on solicitors, but don't want to do the 'wrong' thing.

13 year relationship, 10 years married, 2 kids.

If he hasn't registered matrimonial home rights you could take the course you have outlined - but be aware it could be stopped in it's tracks if he does register.

Are you in the process of divorce? Or actually divorced? A final decree of divorce/final order would mean home rights cannot be registered. Lodging the funds would be wise but be cautious of impact on benefits etc. You could ask the conveyancing solicitor to retain the funds.

As you have children the priority is secure and stable housing for them. You may want to consider whether an application to court to resolve finances would be appropriate. This can be done as litigant in person. This site offers services to support LIPS with the court process.
