What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello, Firstly I would like to thank all contributers for their knowledge and support. I have found this site to be a reassuring and useful tool in an extremely complicated and difficult to navigate system.

My question to day is regarding submisiion of an E bundle. To clarify:

The FA was held in March 2024
The Respondent did not submit any documents until the 6pm the evening before.
The Respondent is represented. Their Solicitor is not responding and has so far not been willing to collabotrate on any documents including completion of the ES1 and ES2.
To date, the FDR hearing has not been listed.

I am unable to submit documents electronically as a LIP, as far as I can tell, the responsibilty lies with the represented party.
There has been significant transactions that has delayed the hearings resulting in assets being transferred to family members by the Respondent.
It is apparent that the Respondent will not be submitting any documents unless we have a hearing date listed.

My first question is, can I submit the bundle by post? I do not have access to an electronic portal.

In addition the Judges order from the FA, clearly states the FDR hearing will be listed 4 weeks after submission of all documents, which will not happen unless I am able to submit them.
I am confused at wether this means all documents including ES1 and ES2 or just the documents the Judge requested in the Order following the FA.

I believe the ES1 and ES2 should be submitted 3 days prior to the FDR hearing?

In addition, I am not comfortable with relying on their Solicitor to submit the e bundle. Can I take control of this situation to ensure all documents are filed with the court in time for the FDR, when it is finally listed.

Thank you in advance for any advice and guidance.

With gratitude
