Hello,

My husband and I agreed a 50/50 split and filled in a D81 which has been drafted up by solicitors and ready to sign. Husband has since changed his mind and we are now having financial mediation to see if he should get more than me. The question I have is that having made a previous agreement that is in writing does this signal "intent" of any kind. Can I use this to show that he was previously happy with the 50/50 arrangement?

If you each had solicitors advice there may be an argument that there is a concluded agreement which is rather like accepting the terms of a contract. You could apply to the court for an order in the agreed terms.

However, before taking action you should seek advice as there are aspects which will have a bearing upon such an application e.g. where not all disclosure was made.
