What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,

I am currently in the process of discussing an equitable settlement with my ex and we are at loggerheads over 1 specific matter.

As a teacher at a private school, I receive 2 free school places for my children, which is part of my package and is not reflected in my salary. However, my ex has a salary which includes accommodation allowance and many other extras. If for example, I remain in this job for the entirety of my children's education, my children would have received a private education for free via my job. My ex would not have to pay anything for this, but my argument is that if I didn't have this particular job and we still wanted private education for our children this should be a factor in our financial agreement.

I'm interested to hear any other points of view or if there is any legal merit in this stance.

Thanks for any help.

Is it a taxable benefit?
If you didn’t get it would your children go to state schools?
What are you arguing? That your total benefits package is worth far more than your salary?

Thanks for your reply.

No, I live in the Middle East, so no taxes. It comes with the job. If I didn't work here I would move back to the UK and they would go to a state school. I'm arguing that my 2 children enjoy private education because of my job. My husband doesn't have to contribute at all. I would like this to be taking into account whilst discussing the financial split. Thanks
