Hello - What is the position please if an FDR is adjourned because the LIP Respondent has been unable to supply three independent valuations for his property because the tenant at the property is refusing entry - they are in arrears, too. The current situation is that the Applicant on Legal Aid has been granted an adjournment and it was granted by the DJ. However, there was no assistance given to the Respondent in the form of a Court Order that would override the tenant's right to refuse entry for valuations only a date ordered by which, miraculously(!), these valuations would be produced before the adjourned FDR. The Respondent did offer a Zoopla valuation - usually fairly accurate and in accordance with his estimated valuation on his form E. Should the DJ have refused an adjournment and accepted the Zoopla valuation in lieu of the three 'agent' valuations and assisted the LIP Respondent with a Court Order aimed at facilitating these valuations to take place in the interim? TIA.
