Hi,

We are going through divorce and we will be applying for the Clean Break order soon. Married for 6 years (Out of 6, we have been separated for about 2.5 years). My stbx had debt before marriage which carried on throughout the marriage. Also during the time we were separated the debt was doubled. When we separated years ago we agreed that each keeps their own finances and now we want to apply for a clean break with the same agreement. He has some property equity but if he substracts the liabilities, then the net assets are quite small. My savings are about 28k more than his net assets. I have no property. Will the judge consider the fact that his debt doubled after the separation and we had a mutual agreement in place then?

My stbx has lost their job, but is actively looking for one. Meantime I am full time employed. How likely is this to impact the clean break order? Is his earning potential considered? My stbx salary range is higher than mine.

It’s a short childless marriage and you’re both in agreement.
Judge is unlikely to have any issues with it.

Thank you!! I was worried about the fact that stbx is currently unemployed and his only asset is the property equity, no liquid cash, while the liabilities are present monthly. Would the judge be likely to suggest a maintenance order or something?

Considering their income will be 0 in the form, would it be best for us to write a note in one of the boxes further down in the form to explain the fact stbx is actively looking for work?
