What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

So my husband decided to appeal the Order from the FDR hearing. This went to Family Court in Central London. I agreed to his demands and suddenly the final hearing was on 23 April. My husband and I communicated on 19 March and he said he would write to the Court (he is now a LIP)as we were not trial ready. Then on the 16 April i received an email from FRC confirming hearing the following week. On the 22 April i started receiving emails from his solicitors trying to vacate the hearing. I have no clue what happened. Today I was advised that our final hearing is now on September 11 2025.

The final hearing is in November. Husband has made a final WP offer of £260 and 34% of his pension. i found a really good arbitrator but he is not interested anymore. he keeps telling me that his litigation loan is a marital debt. Is this right? He has borrowed about £120,000 against the FMH.

He is also very involved in a new relationship with someone who has been around since 2005. They were together for about 2 years but were unable to move on due to her private plans. Now they are a couple his attitude towards me is so vitriolic.

The FH hearing is going to cost around £30.000. Is it worth it??????

You probably deserve around £400k from the FMH and £180k of his pension to equalise. £260k and 34% seems extremely low given that you have had two kids and have less assets than him. If it was me, I would be brave and go to court with a barrister.

What does the £30k in legal fees relate to?

He will probably offer you £350k and £150k of the pension on the day of the final hearing. Don't give up. You will regret it for the rest of your life if you give up. The Judge will probably protect you and make sure you get what you deserve.
