Hello everyone, I guess this is my last post after being on here 18 years, ( nearly).
I need some proper advice please,

My child is 18 next month, he starts a 3 year degree course at university in September or October this year. It's been a private agreement between myself and his mum, not through the CMS, can someone please give me information, according to law so my boys mum doesn't start getting funny.

When does the maintenance payment stop ( my last payment to his mum) by law.

As he's 18 in April, when does his child benefit stop?

Do I have to carry on paying maintenance at all as soon as he hits 18.

I pay the maintenance on 23rd each month. I've never missed a payment, he's 18 on April 7th, so by law and child maintenance laws when is my last payment please,

You guys have been fantastic to me over the years and I'm so grateful, slot if pains, ups n downs, depression, anxiety, lots of things,

So hopefully this is my last question and want to get it right,

If it’s a private agreement it ends whenever either of you no longer agree with it. You can stop at anytime.

For CMS purposes it would end on the first Monday in September as would Child Benefit.

Thank you wyspecial, I emailed my boys mum, she said he's doing a 3 year degree course at university to teach children , and I should still carry on paying till he's 20. years old. She said it's the law and if I stop paying she will go to court or CMS,

I've only missed about 4 payments when I've been out of work.

And he emailed me to say leave him alone and let him get on with his life,

I know he has been manipulated, but you can see why people stop paying at 18.

Do you know what's required if me by law please as I don't want to get into any arguments about payments.

CMS might be 18.

Nothing is required of you by law.
Courts only deal with child maintenance by consent so she can’t go there.
CMS goes up to age 20 or end of non advanced full time education which is A levels or equivalent. Uni is advanced education so she won’t be able to go there.
Child Benefit will end on first Monday in September and if you were paying via CMS that’s when CM would have ended to. You have a private arrangement so can end it at any time and she can apply to CMS - but it will end in September.
I would suggest keep quite, keep paying until September ( your late August payment) then just stop. It’s over, you’ve made it to the finish!
If you wish to you could pay your son money to support him while he is at uni but you have no obligation to and it sounds as if your relationship with him is broken at the moment.

So if I finish paying in august, that's it. Even if university is classed as full time education, that's the bit that scares me. So by law I could stop in August and I still don't have to pay him.

She can't do anything by law to get more money after September 2025. Is that correct?

I will however save his money for when he needs it. I won't tell him, but I haven't missed it for the last 18 years, so I'll save it.

Oh and are you definitely sure a 3 year course at university studying for a degree isn't classed as full time education in a private agreement, just making sure you understand.

And yes, because if the manipulation I've lost my son forever.

I hope one day, he texts me or knocks on my door for a cuppa.

After September there will be nothing she can do to extract child maintenance from you. Just stop paying after the August payment.

A private agreement has no legal status. Either of you can end it at any time. Loads of people have private agreements then at some stage stop agreeing and go to CMS.

You have nothing to worry about. Your time is done.

Hopefully your son will get in touch one day.
