What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My husband has applied for divorce I have received the form to fill out and send back as the respondent. I am unsure about question 7 Do you intend to ask the court to delay the divorce or dissolution until it is satisfied with your financial situation? We do have finances to sort out which involves the marital property should I tick yes or no. We are attending mediation shortly, it does say if I tick yes I have to fill out more forms form B. I am hoping we can solve things amicably without spending too much on solicitors thank you

Main reason for wanting delay is if there are pensions which would pay a survivors pension to a spouse.

If you ex died in the time between the divorce and sorting the pension split then you would no longer be a spouse and wouldn’t get anything.
