What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello, you can see my history on previous posts. At the end of April we received the sealed order and we have now been advised that the final hearing has been set for December 2025. My husband and I were discussing mediation for costs purposes. However today he stated that "I cannot consider an offer from you where you come away in a more secure financial position than me. I do not see that as fair or just." This is what I have been trying to find out before mediation commenced. To me there was no logic in trying mediation if all he wanted was further disclosure and to justify his offer. Ultimately he wants to offer me £155,000 for the FMH (valued at £855,000) and give me £70,000 offsett from his pension (238,000). So that leaves him with the FMH, his investment property and his pension intact. So if he sells both properties and repays his loan (150,000)the money he has given me that still leaves him with 605,000 . I will have £550,000. However it is very likely he will get the money as early inheritance from his parents so will keep his properties.
Since reading this last message from him I accept we will be heading for the final hearing. The FDR hearing recommended 50/50 for the FMH , keep our properties and 80% of his pension. But he balked at that idea. Has anyone had the experience of final hearing? Did the judge direct near to what was suggested at the FDR hearing?

The FDR figure gives you a good idea.
What the judge at the FDR is saying is that if it were the final hearing that they were hearing today that is what there judgement would be. The actual final hearing will be a different judge who may have other ideas but it gives you some idea of what to work towards.
