What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi All,

Had an FDR scheduled for the July 2025 then the court cancelled it on the basis that there we not enough judges. Now they have moved the date to 7 months later in February 2026 which is ridiculous as everything was ready and submitted. Is it possible to submit a request for an earlier date as this is all causing me more financial, emotional and mental strain?

Thanks for your response.

You can ask but the chances are that the listing is the earliest available time. Ideally when a case such as yours is 'bumped' it would be listed in fairly short order but that might displace something else which kicks the can along the road.

The real problem is the shortage of judges and court resources. There are too many people going through the court system.

The Court service encourages people to have a private FDR (pFDR) which is when you effectively hire someone to be a judge - usually a barrister - to preside over the FDR. If an agreement is reached an order is prepared and submitted to the court.

A pFDR cost more of course but it does foreshorten the process as you can arrange one within a month in most cases.
