My husband is English. We live in Austria. He is going through mid life crisis and tried to divorce me here but couldn't afford it. He was told that if he moves and register in England, he could divorce me while I am staying in Austria. He found himself a woman there who he is living with. He wants to pay for my children's education only, no alimoney. We have a credit here (we both paid the capital for the apartment) which he wants to stop paying for soon so I vacate the apartment and be forced to sell it before the bank takes it. He is planning to return just at the time of selling to take his share. We have been married for 21 years and have two children. He is making the rules. How can I be helped while he is taking action there and I am here regarding the financial assets.

I assume that if he divorces you in England then you will be entitled to file for ancillary relief and then the division of marital assets will come under English law... I may be wrong... but I'm sure someone with more legal knowledge will be along soon to help.

Hi yes i beleive you can file for Anc releif . My ex lives in Dubai but filed for ancillary releif against me & divorced me for my apparent unreasonable behavior . He used a Uk family law solicitor .After 21 years & with 2 children , you are entitled to an awful lot more .

Any idea what is the position if the divorce took place sometime back in the UK where both parties lived, but now both live abroad in different countries. Can AR still be pursued through UK court?
