hi, i'm not sure if this is right place to ask a question but here goes.

i have three children living in a two bedroom property from a housing association. they provided me accomodation 18 months ago.

i have 10 yr old girl soon 11 going through puberty, 4 yr old boy and baby boy whos 1 same time as eldest.

my question is- is there a law where children should not share? can anyone help me? point me in the right direction?

my daughter has been diagnosed as claustrophobic. which doesn't help in such small home.

Hi Tiggers,

Unfotunately the definition of overcrowding hasn't been updated since 1935 and the following all applies at the moment:

1. Unbelievably living rooms and kitchens are considered acceptable sleeping spaces. So even though you are in a 2 bed flat your property is classed as having 4 rooms that you and your family can sleep in.

2. Shockingly children under 10 count as half a person, and babies under one don’t count at all.

3. According to the law, a family of five living in a one-bedroom flat would not be classed as living in overcrowded accommodation.

Shelter are calling on the Government to update the definition of overcrowding and bring it into line with modern day standards...but who knows if and when they will have any joy...

If two people of the opposite sex have to sleep in the same room the accommodation will be overcrowded unless the two people are:

1. a married or cohabiting couple, or
2. at least one occupant is under ten years old.
