What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Apologies if this isnt the right place post this but couldnt find an exact header.

I will try and keep this brief.
I have just completed what has been largely an amicable divorce.

However, before separation I took out a loan in my name on my wifes behalf. She has been paying me monthly since, no problem however I got a Consent Order drawn up by a company just cover me.

This was approved - the document got lost in the post but as it was stamped I went to the court for the decree absolut.
To my horror on receiveing the document I hadn't noticed that the company that draughted the document had got Petitioner and respondent the wrong way round so it now says I owe my ex wife the loan money.

This is a disaster and although its been amicable I need to rely on her to re-sign something.

Can I get a new amended consent order re-signed and submitted to a judge even though I am offically divorced or is there any other document I can get drawn up?

Many Thanks.

Yes you can have it amended. Speak to the company who drafted it and tell them to sort it asap.
