What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi I am finding the whole experience absolutly dreadful and now I am concenred that my solicitor my not have advised me when she should have done.

I have been separated for a year now my husband wants to remain in our home. I rented a room but soon found this to be unsuitable I have since spent my time from place to place. I have now managed to get a mortgage and a loan from my dad to buy a house. My husband and I have not come to a financial agreement as yet.I made my solicitor aware that I was looking to buy a property. I purchased a property and informed her she then said I would receive a more generous settlement if I had not bought a house. Shouil she have advised me of this sooner? Will it make a difference?

The court will try to split finances to enable each party to rehouse if possible. As you have housed yourself the pressure is off and the court may feel that your entitlement is less.

The question is, did you inform your solicitor of your plans prior to purchasing a house? It's one thing saying you are looking for a house but another to obtain family assistance to get amortgage and purchase a property.

Hi

Thanks for your response. I told my solicitor When I put the offer in on a house and about my financial arrangements the house fell through and then I started looking again for a property at no point until I told her that an offer had been accepted did she say I should not purchase a house. I want £20,000 less capital than my solicitor advised me I was entitled to but now feel that things could go very wrong and I won't be able renovate the property I have bought.
