Hi Forum

Does anyone has know who to apply in High Court for compensation.

Briefly my son was abducted by his mother due to county court given her permission to travel.The judge did not brother to look weather the country where she is going is a Hege Country or Non Hege country.

He simply asked her to sign an undertaking and go for 4 weeks.

This is clearly a court mistake and I want to apply for compensation for all my due and stress I have suffered.

Any claim you had would be against your ex, not the court.

If you had a solicitor, and if you had instructed them that you belived there was a risk of abduction, then they should have checked whether it was a Hague Convention country and if not, discussed with you, and if necessary proposed to the court, that additional safeguards were needed.

the sad thing is I raised clearly in court that my ex can abduct my son.but judge given me to 5 minutes to think and then come into hearing(both parties).

My barrister insist me if I did not allow ex trip,she would apply for in court and there would be other hearing.

SO I changed my statement and allow this.
But no body including both parties solicitors and judge did not bother to look on issues i.e Hege or non hege country.

In High Court judge said this is cleary a court mistake and county court shoudn not have allow this just taking an undertaking.Later wardship order were issued regarding child.
