What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi, Im a staff Nurse within the Nhs, ive paid my superannuation pension since I started which is 12yrs now! Im currently separated from my husband and am considering divorce! We have a matrimonal home which is currently up for sale! My husband has informed me that he has spoken to his solicitor and has been informed that he is entilted to my pension! I find this hard to believe since I paid this pension myself! He did not work throughout our marriage and I am questioning how he thinks he has any entiltlement to this! Can u please enlighten me! Is he right?

Welcome. Yes he might have a claim on your pension but in order to give advice the more knowledgeable wikipeeps will need the full picture. It would also be useful to know why your stbx did not work - is he disabled? was he looking after the children?

Your respective ages;

The number of children you have and their ages;

How many nights the children spend with each parent;

The length of your marriage and any period of pre marriage cohabitation;

Your respective incomes;

Your respective outgoings;

Your assets - both solely held and joint;
