What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Would a segal order have helped?

The husband was given FULL financial responsibility for the child as part of the asset split. The child lived with the father who later applied to the CSA for child maintenance.

The Wife did not get any spousal maintenance.

Would a Segal Order of SM+CM = 0 have circumvented nine years of a cat and mouse nightmare between the CSA and Wife, (who was an incurable disabled person), with the CSA?

It could not be a segal order if no sm was agreed or ordered.

It''s a mute point really.

The court wouldn''t be able to remove the financial responsibility of the mother to the child though which is effectively what this would be attempting to do.
