Can someone ''legal'' please remind me what the part of the court order is called before it actually goes into the part where it says ''the court orders that'' .......... sorry haven''t got a copy in front of me. I have an order dated Apr 12, and because my son has changed the nights with his dad, and he doesn''t agree or want to pay for the additional nights, he has asked the CMS to revert back to the original court order. I seemed to recall that because the child arrangements were mentioned in the beginning, and not included in the actual court order that is wasn''t valid or something like that. Sorry for the ramble and hope it is clear what I am asking. Thanks..

It''s the recital, although I''m not sure it will make much difference as far as the CMS is concerned. When parents dispute the amount of shared care the CMS will look at a court order as evidence of the arrangement and although technically arrangements are in the bit before the heading "Orders" it is still evidence of the arrangement.
