What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

CHALLENGE 1

Me 35, Irish living in the UK 8 Years.
My wife and I are separated since 08/11.
She will not communicate with me in the slightest. She now lives in Eire.
I want to divorce but am unsure on what grounds.
The main reason why we separated was due to an affair I had (although the real reason was severe financial pressure,me not being able to have kids)

What should I file for - Unreasonable behavior ? Desertion

CHALLENGE 2

I have an old address for her but know where she works. I am 100% confident she will not respond to a petition

What can I do - I''m pulling my hair out

You will require her residential address for the purpose of serving the divorce papers (which the Courts do). A work address isn''t permitted. There are a number of ways you can find out her address, and if you are unsuccessful yourself, you may need to engage the services of a Process Server/Location Officer to find her address for you.

If she isn''t communicating with you, and you don''t have her consent to a divorce on the grounds of two years separation, then you will need to use unreasonable behaviour. Your online provider should be able to answer your questions - make sure that you are getting the appropriate service for your situation.

Our guide to divorce is worth reading to familarise yourself with the process: www.wikivorce.com/divorce/Guides-Divorce...-Initial-Checks.html
