What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi There,
If you have had a solicitor representing you and now due to costs you need to take control and manage your case as a LIP and end your contract with the solicitor:
1-Can you request your case and all the paperwork and notes electronically?

2-Would the solicitors charge to send this to you electronically? what is the normal practice?

3-Can I request all my case notes/file under the freedom of information act and would there still be a charge?

Many thanks

Once you have paid your final bill, your file should be sent to you (always best to specifically request it). It's your file, and belongs to you.

The file may well contain both digital and paper documents so be prepared for some to be sent electronically, and some to be sent in the post.

No need for a FOI request.

When swapping to a new solicitor my partner asked for his files but never received them.
