Hello,

I believe he was supposed to be paying half of the building insurance every year which he hasn't done. That how I interpreted that passage Tbh, I'm not bothered about that.

The rest of the order doesn't say anything about being responsible for 50% of the repairs. That's the only relevant bit. And yes, the intention is that his half would come out of his 30% of his equity payment when I remortgage. I've got a structural engineer coming today and depending what his report says needs to be done then I'll know better.

When I've shown that to people, they have interpreted it to mean he needs to pay for half of any structural repairs. How would I get more clarity around the wording in the order? Is there a forum I could post that in?

Even if he agreed to pay his half from the 30% equity, I would not take his word so I'd need some kind of legal document to back it up which was why I was going to submit the d50k.

Why not initially get the job priced and then contact him pointing out how much his 50% contribution is?

Depending on the cost you never know but he might just pay up.

If not you could then seek the help of the court to enforce the order and if needs be adjust things to recognise that what he is due is now lower.

You could post the order on here but make sure you redact anything that could identify you. Alternatively ring the helpline and get a professional opinion.

Yes I have someone who will price it up once the structural engineers report comes through. It's not as bad as first believed which is good.

I'm happy to post the full order but not sure which forum is best to do that?
