What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My solicitor was sent the divorce papers last thurs by my stbx solicitor saying they had filed them into court and I had to pay all his legal fees and that we didn't have an agreed financial agreement.

Solicitor phoned me this morning and the papers have not been filed into court, they just sent them to us and pretended!

Does this have implications for him?

I would have thought it depended on whether the solicitor honestly believed the papers had been lodged at the time the statement was made.

Just as a little juicy snippet for you, let me tell you about something that happened in the town where I used to practise. THIS IS TRUE !

A solicitor had been delaying his client's divorce inordinately and was under ever increasing pressure from the client who wanted to re-marry. Eventually he took someone else's divorce certificate and forged a
Decree Absolute for his client.

However some time later - - -

The client and her new ' husband ' met her former husband in the street and introduced her NP to him. He of course said they were still in holy wedlock and the client produced the forged certificate.

The balloon went up like a rocket !! The solicitor
( no longer a solicitor ) finished up spending an enforced rest from public life at Her Majesty's expense.

I've never forgotten that and I don't suppose the couple have either !
