What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi guys.

Have any of you heard of a Coldwell or Colwill Letter? My understanding is that you use this letter to set out what would be an acceptable settlement for you and this is presented to the other party and the judge.

It was suggested to me as a possible way forward in my own ancillary proceedings but haven't been able to find much out about it.

Thanks

Hi there

You mean a Calderbank letter, which is what offer letters used to be called because of a case of Calderbank v Calderbank. However, these have now gone.

Thanks for that guys - I didn't realise they were no longer in use. Everyday is certainly a school day on wiki.

LIB,

Although the basics are correct, please please be aware that is an Australian law article - Australia has different law but sometimes pinches our precedents.
