What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi my partners wife walked out on him

Tina describes him as "partner" and refers ro the assailant (!) as "wife" (so we can assume she's not yet ex wife)

This just shows that if closure isn't put on a marriage (that ended six YEARS ago) that he cannot be in a clean space to move forward.

Tina is a girlfriend, ex is still wife, and under martimonial Law the wife has more right. (This isn't what is ethically right; just how the law works until they are divorced). Just as if he died, (leaving his 'wife' next of kin) she'd have you ousted from the home you now share with this man.

...it's best he starts proceedings to put an end to this.

I suppose the only thing I would do now would be to report it to the police, telling them that you had been away on holiday and had arrived home to find that someone had broken in. Trouble is that was a month ago I understand, should have perhaps called them straight away.

You could have suggested some names. Received an incident number, at least if there was anything that needed replacing on the house insurance there would be an incident number.

Need to get that divorce started pronto!!!!!

Change the locks and get a burglar alarm system put in in the meantime.

unfortunatly the house is in joint names so i know she has a claim to half the building even if he is the only one who paid the mortgage she is still entitled to half
