What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Returning home after moving out - long story sorry

My dad left the home earlier this year, after deciding he wanted out of his marriage (a total bolt out of the blue to mum). Mum wants to stay in house for the next few years, before she feels ready to move (her legal right to do so). He placed a deposit for a house abroad (life-long dream) and began renting in UK. Despite being told by all of us he could not afford this plan, he went ahead with deposit. Now surprise surprise he is struggling to get mortgage for house abroad and looks set to lose deposit. He asked mum to sign to put their house as collateral for house abroad, but she has refused as there is, of course, risk on the house if he does not keep up payments. Now he says the only way he can afford his home abroad is to give up renting in UK and is moving back home. In this, I assume, he hopes he will (1) persuade her to sign the house as collateral and/or (2) persuade her to initiate the divorce proceedings. In effect he is taking away her choices - i.e. to stay in the house until she is ready to move, and to continue to move on in her life without him being there. Is there anything she can do to stop him moving back in, and still stay in the house and area (she could not afford to stay there if they sold now).
This seems so incredible unfair.
Anyone with any knowledge please advise? - she is of course getting legal advice, but I am keen to hear if anyone has any advice.
